Terms of Use

These Terms of Use ("Terms") are a binding agreement between you and Tonic ("we", "us", "our") governing your use of the Tonic app, website, and related services (the "Service"). By creating an account, running a scan, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What Tonic is (and is not)

Tonic is a cosmetic and self-care product for men. It reads how your skin looks and suggests simple upkeep steps. Tonic is not a medical device and does not provide medical advice, diagnosis, or treatment. The "freshness" read and any suggestions are for general cosmetic guidance only. For any skin concern, symptom, or health question, consult a qualified dermatologist or doctor.

2. Eligibility

You must be at least 18 years old and able to enter a binding contract to use the Service. The Service is intended for adults and is not directed to minors.

3. Your account

You are responsible for keeping your login credentials secure and for activity under your account. Provide accurate information and keep it up to date. Notify us at hello@tonicc.app of any unauthorized use.

4. Your scans and content

You keep ownership of the photos and content you provide. You grant us a limited license to process them solely to operate and provide the Service to you (for example, to generate your read and plan), as described in our Privacy Policy. You confirm that any photo you scan is of yourself, or that you have the right to submit it, and that doing so does not break the law or anyone's rights.

5. Acceptable use

You agree not to:

• use the Service for anything unlawful, harmful, or abusive;
• scan images of other people without their consent, or any content you have no right to use;
• copy, resell, reverse-engineer, scrape, or misuse the Service or its content;
• interfere with security, disrupt the Service, or attempt unauthorized access;
• rely on the Service as a substitute for professional medical or mental-health advice.

6. Subscriptions, billing, and cancellation

Some features require a paid subscription. Prices, billing periods, and what is included are shown before you buy. Subscriptions renew automatically for the same period until cancelled, at the then-current price. You can cancel anytime; cancellation takes effect at the end of the current billing period and you keep access until then.

Where you purchase through an app store (Apple App Store, Google Play), billing, renewals, and cancellations are managed by that store under its terms; manage or cancel in your store account. For purchases made directly from us, cancel in the app or by contacting hello@tonicc.app.

EU/EEA right of withdrawal: consumers generally have 14 days to withdraw from a purchase. Because digital content and services can begin immediately, you may be asked to consent to immediate performance and to acknowledge that the withdrawal right ends once the service has been fully performed. 7. Care products and third-party links

Tonic may suggest care products and link to independent retailers. We do not sell those products and are not responsible for them; your purchase is governed by the retailer's own terms. Some links may be affiliate links, meaning we may earn a commission at no extra cost to you. A suggestion is not a guarantee of any result.

8. Health and wellbeing

Tonic is designed to be honest and non-shaming, and the read reflects cosmetic appearance, not your worth. It is not a beauty or attractiveness rating. If comparing your appearance causes distress, please step back and speak with a qualified professional. Nothing in the Service is medical or psychological advice.

9. Intellectual property

The Service, including its software, design, text, and the Tonic name and logo, is owned by us or our licensors and protected by law. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for your own use, subject to these Terms.

10. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind to the extent permitted by law. We do not warrant that results, scores, or suggestions are accurate, complete, or will achieve any particular outcome, or that the Service will be uninterrupted or error-free. Nothing in these Terms limits rights you have as a consumer that cannot be limited by law.

11. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, or for loss of data or profits, arising from your use of the Service. Nothing here excludes liability that cannot be excluded by law (such as for death or personal injury caused by negligence, or for intent or gross negligence). 12. Indemnity

You agree to indemnify us against claims arising from your misuse of the Service or breach of these Terms, to the extent permitted by applicable law.

13. Suspension and termination

You may stop using the Service and delete your account at any time. We may suspend or end access if you breach these Terms or to protect the Service or other users. Provisions that by their nature should survive termination will survive.

14. Changes

We may update the Service and these Terms. If changes are material, we will give reasonable notice as required by law. Continued use after changes take effect means you accept the updated Terms.

15. Governing law and disputes
